仲裁的本质、属性以及特点决定了对仲裁进行司法监督的必要性和正当性,纵观目前各国的仲裁立法,几乎都有对仲裁进行司法监督的相关规定,只是监督的程度和模式各不相同。我国目前对仲裁采取事前监督和事后监督并存、撤销和不予执行仲裁裁决双重监督、国内仲裁裁决与涉外仲裁裁决双轨监督的模式,由于过于严格而违背了仲裁独立性的原则,不利于仲裁优势的发挥。因此,我国仲裁立法有必要赋予仲裁庭自裁管辖权,并对国内仲裁和涉外仲裁实行统一的程序监督。
