梳理中国法治模式理论,有“外来型抑或本土型”“政府主导型抑或社会促进型”和“法律主治型抑或综合治理型”三组主要讨论,与之对话、反思后认为,中国法治模式问题关键在于解决中国法治理论和实践之间的张力,应选准宏观民主实践和微观权力机制为着力点进行创造性转换。法治模式建构不是用来证明本土传统的可靠性,也非论证外国法律资源的优越性,而是能从法律视角解决自身现实社会争端。如果忽视自身民主实践和政治特色,那么某种“法治模式”形成的同时,也可能是自己真实法治实践的结束。权力“协同化”、民主“集中化”的民主生态是法治中国理论探讨的特质所在。
Combine the theory of the Chinese model of the rule of law with the following three major discussions: “foreign or indigenous”, “government-led or social-promoted” and “legal-based or integrated governance” He believes that the crux of the issue of the model of the rule of law in China lies in resolving the tension between the theory and practice of the rule of law in China and that the mechanism of macro-democracy and the mechanism of micro-power should be chosen as the focus of creative transformation. The construction of the rule of law model is not used to prove the authenticity of indigenous traditions, nor to demonstrate the superiority of foreign legal resources. Rather, it can resolve its own real social disputes from a legal perspective. If we neglect our own democratic practice and political features, then the formation of a certain “model of the rule of law” may also mean the end of our own practice of rule of law. The democratic ecology of “power”, “synergy”, “democracy” and “centralization” is the characteristic of the theory of law by law in China.
