“傍名牌”现象是一种侵犯知识产权的不正当竞争,在电动车市场非常普遍。文章通过对某市的调研发现,“傍名牌”电动车的消费者主要是非公职人员。通过因子分析,发现文化层次和文化修养低、贪便宜的心理、盲目从众心理、追求个性张扬等因素是消费者选择“傍名牌”产品的主要原因。当前“傍名牌”企业的违法成本低,在相关法律法规还未完善的情况下,应通过加强中小学生的品牌和专利知识教育,充分发挥政府相关行政部门的监管和宣传职能,鼓励生产企业之间实现专利共享等手段,逐渐让“傍名牌”产品失去市场。
