我国工会组织在市场经济制度的建设中发展起来的,它是公民们维护自己的合法权利与利益的基本组织,在的作用在社会的发展中已经凸显出来并且得到了社会的认可。是社会发展不可或缺的,但是由于对工会权利的限制,使其无法给与对政府以及企事业相对应的制约权,那么在工会实施它的权利时就受到了很大的阻力,就与工会角色在法律上的认可程度相冲突。达不到维权的目的,从而就会激化员工与企业间的冲突,影响社会的稳定性。本文通过对工会在维权中的角色冲突的起因、现状以及解决措施来进行探讨分析。
China’s trade union organizations have developed in the construction of a market economy system. They are the basic organizations in which citizens safeguard their own legitimate rights and interests. Their role has been highlighted in the development of society and has been recognized by society. Is indispensable to social development. However, due to restrictions on the rights of trade unions so that they can not give the government the right to control enterprises and enterprises, there is a great deal of resistance when the trade unions exercise their rights. The degree of legal recognition of trade union roles conflicts. Fail to achieve the purpose of safeguarding rights, thereby intensifying the conflict between employees and enterprises and affecting the stability of the society. This article explores and analyzes the causes, current situations and solutions of the conflicts of the trade union’s role in the defense of rights.
