如今中国的动漫产业虽已蓬勃发展了十多年,但在动漫角色真人化产业中,动漫作者著作权的保护及表演者财产权的保护仍是一个重要的问题。不同的国家对此制订了相关的法律,但由于动漫作品本身的地域性及时代性,相关法律规范不仅缺乏统一,更缺乏立法上的前瞻性。因此,建立统一的国际动漫作品著作权保护机制,及在扶持文化产业基础上的立法完善是解决问题的重要途径。
Although the animation industry in China has boomed for more than a decade now, the protection of the author’s copyright and the protection of the performer’s property rights remain an important issue in the live-action animation industry. Different countries have formulated relevant laws, but due to the geographical and timeliness of the animation works themselves, the relevant legal norms not only lack uniformity but also lack the legislative foresight. Therefore, it is an important way to solve the problem to establish a unified copyright protection mechanism for international cartoon and animation works and to improve legislation on the basis of supporting cultural industries.
