人社部发布的《劳务派遣暂行规定》已于2014年3月1日实施,新规有六大亮点:一是辅助性岗位需协商确定,工会拥有发言权;二是严控劳务派遣用工比例;三是明确工伤责任主体;四是完善了退工机制;五是明确劳动合同解除情形;六是强化了防范劳务派遣异化的措施。
The “Interim Provisions on Labor Dispatch” issued by the Ministry of Human Resources and Social Security was implemented on March 1, 2014. The new regulations have six major bright spots: First, the auxiliary jobs need to be determined by consultation and the unions have the right to speak; and the second is to strictly control the proportion of labor dispatch ; Third is the main body of responsibility for work-related injuries; Fourth, improve the mechanism for the termination of work; five is to clear the situation of the lifting of the labor contract; Sixth, to strengthen the prevention of dispatch of labor alienation measures.
