香港基本法的基本原则主要由基本法的第一章“总则”中予以确定。“总则”共有11条,从政治、经济和法律等方面,规定了香港特别行政区实行的制度和政策的基本原则,这些原则,具体体现在基本法各章的条文规定中。慨括起来,有以下一些基本原则。(一)香港特别行政区是中国不可分离的一部分基本法第1条规定,香港特别行政区是中华人民共和国不可分离的部分,这一规定,体现了维护我国国家主权、统一相领土完整的原则,因而是一条十分重要的基本原则。(二)香港特别行政区实行高度自治基本法第2条规定,全国人民代表大会授权香港特别行政区依照基本法的规定实行高度自治,享有行政管理权、立法
The basic principles of the Hong Kong Basic Law are mainly determined by the first chapter of the “Basic Law”. There are 11 articles in the “General Provisions”, which stipulate the basic principles of the systems and policies practiced by the Hong Kong Special Administrative Region from the aspects of politics, economy and law. These principles are embodied in the provisions of the chapters of the Basic Law. To sum up, there are some basic principles as follows. (1) Hong Kong Special Administrative Region is an Inalienable Part of China Article 1 of the Basic Law stipulates that the Hong Kong Special Administrative Region is an inalienable part of the People’s Republic of China. This stipulation reflects the principle of safeguarding the national sovereignty of our country and unifying the territorial integrity and therefore is A very important basic principle.
