《技术、教育和版权协调法案》对1976年美国版权法作了修改,将“合理使用”制度延及到数字化环境下的远程教育。同时,为切实有效保护版权人的权益,协调法案对远程教育机构及其信息技术人员、教师作了具体要求,体现了版权制度的“平衡精神”。通过分析该协调法案,并反观我国版权制度,发现其已不适应我国现代远程教育的发展,有必要予以修改。修改时,应借鉴协调法案的相关经验。
The Technology, Education and Copyright Coordination Act changed the 1976 US copyright law to extend the “fair use” system to distance education in a digital environment. At the same time, in order to effectively and effectively protect the rights and interests of copyright holders, the Coordination Act has made specific requirements on distance education institutions, their information technology personnel and teachers, which reflects the “spirit of balance” in the copyright system. By analyzing the coordination act and reviewing the copyright system in our country, we find that it has not adapted to the development of modern distance education in our country and it is necessary to be amended. When modifying, we should learn from the experience of coordinating bills.
