法律移植是人类法律进步,法律文化互动与交融的一种主要形式,我国在建立社会主义法制体系过程中也具有重要意义。法律移植在促进移植国法律完善与进步的同时也会与本土法律文化产生冲突,本文以预期违约制度为例探讨法律移植以及如何避免和减少法律冲突问题。
Transplantation of law is a major form of human law’s progress and the interaction and blending of law and culture. China is also of great significance in the process of establishing a socialist legal system. Law transplantation also promotes the legal perfection and progress of the transplant country and conflicts with the local legal culture at the same time. This article uses the anticipatory breach of contract as an example to discuss the legal transplantation and how to avoid and reduce the conflict of laws.
