我国银行个人理财业务蓬勃发展,同时,银行个人理财纠纷也层出不穷,投资者合法权益经常受到损害。我国目前的银行个人理财纠纷救济机制涉及了多种救济方式,基本符合多样化的要求,但是不够合理,存在事前救济乏力、ADR救济不足、诉讼救济不完善、重行政处罚轻民事救济等不足与缺陷。应重视事前救济,加强准入监管,大力发挥ADR制度的作用,不断改进理财纠纷诉讼制度,最终构建合理的理财纠纷救济机制,最大限度地保护理财投资者的合法权益。
At the same time, personal banking financial disputes are endless, and the legitimate rights and interests of investors are often undermined. At present, our country’s bank personal financial disputes relief mechanism involves a variety of relief methods, basically meet the diversified requirements, but not reasonable enough, there is the lack of prior relief, lack of ADR relief, litigation relief is not perfect, serious administrative penalties and civil relief defect. Emphasis should be placed on prior relief, stepping up access control, giving full play to the role of the ADR system, continuously improving litigation system for financial disputes, and finally establishing a reasonable remedy mechanism for financial disputes so as to protect the legitimate rights and interests of wealth management investors to the maximum extent.
