隐性采访所发挥的舆论监督作用有目共睹,使其逐步成了媒体常见的采访方式之一。然而,隐性采访固有的掩盖性、隐瞒性决定了这种采访方式在道德和法律上的争议。从世界各国立法对待隐性采访的默认或公开承认可看出其存在的合理性。未来立法,应当从采访行为地、记者的角色、被采访者的态度以及隐性采访的严格适用条件、证据问题等对隐性采访行为进行法律定性。目前,美国关于隐性采访的一些判例有值得我们借鉴和学习的地方。基于上述,我们提出了几点立法建议,以此作为隐性采访的法律思考。同时我们也不能忽视英国近期出现的新闻窃听侵权的消极影响。
The role of public opinion supervision played by implicit interviews is obvious to all, making it gradually become one of the most common media interviews.
