为适应国际海上货物运输的不断发展,联合国国际贸易法委员会(UNCITRAL)于1996年委托国际海事委员会(CMI)起草了运输法框架草案。本文就CMI运输法工作组会议上关于航次租船合同是否应纳入运输法草案中的问题,从航次租船合同的法律性质及特征、我国海商法关于航次租船合同的立法模式、存在的争议及解决办法等方面,综合比较了我国海商法的相关规定以及其他与会国家所持观点,论证了运输法草案扩大适用于航次租船合同有其必要性及合理性。
In order to meet the continuous development of international maritime trucking, UNCITRAL commissioned the International Maritime Committee (CMI) to draft a draft transport law framework in 1996.
