司法职业道德方面的研究与培训,在澳大利亚法官培训中占有重要地位。本文根据澳大利亚南澳州最高法院首席大法官多伊尔和维多利亚州最高法院大法官蒂格于1996年10月在澳大利亚伍伦贡市举办的“司法培训班”上的讲课稿摘要编译而成。本文以法官(即文中的“你”)一天的经历为背景,介绍了法官在工作、生活、社会交往中遇到的涉及职业道德的种种情境,并在每种情境之后附了讨论题。通过对本文所列种种情形的讨论,我们可以形象地了解司法职业道德的基本原则,提高法官对职业道德问题的敏感度,培养处理此类具体问题的能力,掌握克服困难的方法。本文既能帮助中国法官了解澳大利亚的司法职业道德发展状况,也可以作为培训、讨论或自我检测的素材。
Research and training in judicial ethics occupy an important place in the training of judges in Australia. This article is based on a lecture summaries from Justice Doyle, Supreme Court Chief Justice of South Australia, Supreme Court of Victoria, Supreme Court of Victoria, Tigard, held in October 1996 at the “Judicial Training Course” in Wollongong, Australia. Based on the one-day experience of the judge (the “you” in the text), this article introduces the various situations involved in the professional ethics that judges encounter in their work, life and social interaction. It also presents a discussion topic after each situation. By discussing the various situations listed in this article, we can vividly understand the basic principles of judicial professional ethics, raise the judges’ sensitivity to professional ethics issues, cultivate the ability to deal with such specific problems and master the methods to overcome them. This article not only helps Chinese judges understand the development of judicial professional ethics in Australia, but also serves as a material for training, discussion or self-examination.
