国务院第149号令发布的《医疗机构管理条例》(以下称《条例》)定于今年9月1日起施行。可以预见,它的实施将改变我国医疗机构以行政手段为主的传统管理模式,结束长期存在的多头审批、各自为政的分散体制,为建立适应市场经济发展的符合我国国情的医疗活动新秩序奠定了基础。下面仅就《条例》第六章谈点学习体会,与大家讨论。一、《条例》规定的行政处罚同设置审批、登记注册一样,行政处罚也是一种管理方法,一种手段,而不是目的。1.什么是行政处罚行政处罚是特定国家机关或者法律授权的其他组织,依法惩戒违反行政管理法规但还不够或者未给予刑事制裁的公民、法人以及其他组织的具体行政行为,是由违法者承担的一种行政法律责任承担方式。《条例》规定的行政处罚是指县级以上政府卫生
