不动产登记是不动产善意取得与行政信赖保护沟通的桥梁,前者把不动产登记视为物权登记,后者把不动产登记看作行政登记。行政登记信赖保护的适用要件要求不动产善意取得必须强调第三人善意且不存在重大过失以及真正权利人具有归责事由。在符合不动产善意取得的情况下,不动产登记机关不能撤销违法的不动产物权登记,而是要对善意第三人的信赖利益采取存续保护的方式,同时赔偿因其过错导致真正权利人的损失。
