船舶合同包括船舶建造合同船舶买卖合同等很多种类,文中主要是指船舶建造合同。2009年下半年爆发全球金融危机以来,中国造船业受到外贸与航运市场的双重打击,订单数量锐减、撤船激增,产生了大量的船舶合同纠纷。从仲裁的角度研究船舶合同纠纷的解决,介绍船舶建造合同纠纷的种类,为中国造船业在应对船舶合同纠纷时提供理论支持。
The contract of a ship includes many kinds of contracts for the sale and purchase of a ship under the contract of construction of a ship. The article mainly refers to the shipbuilding contract. Since the outbreak of the global financial crisis in the second half of 2009, China’s shipbuilding industry has been hit hard by both the foreign trade and shipping markets. The number of orders dropped sharply and the number of withdrawals surged, resulting in a large number of ship-contract disputes. From the perspective of arbitration, this paper studies the solution of disputes over shipping contracts, introduces the types of disputes over contracts of construction of ships, and provides theoretical support for China’s shipbuilding industry in handling disputes over ship’s contracts.
