【裁判要旨】综艺娱乐节目的内容、编排、设计以商品宣传为中心,不具有独立性的非商品宣传部分服务于商品宣传内容,属于新型的软性商业广告,应当适用商业广告的严格规则。实验类比较广告的比对对象是可识别的竞争对手商品,如若比对内容非客观真实、比对结果贬低竞争对手商品声誉,则构成商业诋毁的不正当竞争行为。□案号一审:(2013)浦民三(知)初字第764号
