根据我国现行法律,外观设计属于《专利法》保护的客体,知名商品特有的名称、包装、装潢属于《反不正当竞争法》保护的对象。当外观设计符合知名商品特有的包装、装潢条件时,是否可以受《反不正当竞争法》之保护?本文将对外观设计的反不正当竞争法保护作出相关阐述,并主要针对外观设计保护模式、知名商品特有包装装潢作为在先权利时的侵权处理、知名商品特有包装装潢的跨类保护、外观设计专利与知名商品包装装潢权利重叠时的双重保护,以及进入公有领域的外观设计专利是否仍可作为知名商品特有的包装装潢受保护五个方面,结合美国相关法律及司法实践进行分析和探讨。
