我国有组织犯罪在发展历史、成员构成、组织形态、犯罪手段、政治渗透程度、犯罪暴露程度和国际化倾向等方面与西方有组织犯罪有很大不同 :西方有组织犯罪的发展历史几乎是直线式的 ,从来就没有受到过严厉的打击和有效的控制 ;我国政府则曾对其进行过毁灭性打击 ,但近年又死灰复燃。西方有组织犯罪的成员中既有恶棍盗贼 ,也有白领首脑 ,层次丰富 ;我国有组织犯罪成员主要是社会闲散人员和“两劳”释放人员。西方有组织犯罪已具有相当完备的组织形式 ;我国有组织犯罪目前处于雏形阶段 ,但有快速发展的趋势。与西方有组织犯罪的手段有所区别的是 ,我国有组织犯罪的手段更加凶残、野蛮 ,具有极浓厚的封建色彩。我国有组织犯罪的政治渗透能力及渗透程度尚不能与西方有组织犯罪相比较 ,但其危害已不容忽视。我国有组织犯罪的暴露程度比西方要高得多。西方有组织犯罪的国际化程度非常高 ;而我国的国际化程度相对较低 ,主要在本地本省活动 Organized crime in our country is quite different from organized crime in the West in terms of history of development, composition of members, organizational form, means of criminality, degree of political penetration, level of criminal exposure and tendency of internationalization.
