作为危害极其严重的犯罪活动形式,黑社会组织犯罪与贩毒、恐怖主义活动一起被联合国宣布为当今人类的三大灾难性犯罪。面对黑社会犯罪的严峻挑战,各国政府都在积极寻求对策,国际社会共同治理跨境跨地区的有组织犯罪也积累了若干宝贵经验。因此归纳总结意、日、美等国的经验性做法,尤其是其处罚黑社会犯罪的规律,对合理运行我国刑法机制,有效应对中国大陆地区 As a form of criminal activities that endanger extremely serious crimes organized by triad societies, together with drug trafficking and terrorist activities, have been declared by the United Nations as the three most catastrophic crimes in humankind today. Faced with the harsh challenges of triad crime, all governments are actively seeking responses. The international community has also accumulated some valuable experience in jointly managing cross-border and trans-regional organized crime. Therefore, the author summarizes the experience of Japan, the United States and other countries in practice, especially the law of punishing criminals. It is necessary to rationally run China’s criminal law system and effectively deal with the situation in mainland China
