《全民所有制工业企业承包经营责任制暂行条例》(简称《承包条例》或“条例”)是目前调整企业承包关系的主要行政法规,是规范、完善、发展承包制的主要法律依据之一.该条例颁布实施以来,对实行承包制起到了重要的促进作用.但是必须看到,《承包条例》毕竟是承包制推行之初的产物,随着企业改革的不断深化,承包实践的不断深入,《承包条例》中存在的一些矛盾和问题也逐渐显露出来,并不同程度地制约着承包制的进一步完善和发展. 1.《承包条例》规定的承包合同的权利义务主体前后互相抵触.《承包条例》第14条规定:“实行承包经营责任制,必须由企业经营者代表承包方同发包方订立承包合同,发包方为人民政府指定的有关部门,承包方为实行承包经营的企业”.由此可见,承包合同
The Provisional Regulations on the System of Contracting Management of Private-owned Industrial Enterprises (referred to as the “Provisional Regulations” or the “Regulations”) are currently the major administrative regulations governing the contracting of enterprises and one of the major legal bases for standardizing, perfecting and developing the contracting system. Since promulgation and implementation of the Regulations, the implementation of the contract system has played an important role in promoting. But we must see that the “contract” after all is the product of the beginning of the contract system, with the deepening of enterprise reform, deepening of contract practice, “ Some contradictions and problems existing in the ”Contract Regulations“ are gradually revealed, and restrict the further improvement and development of the contract system to a certain extent.1 The contractors’ rights and obligations stipulated in the ”Contract Regulations“ contradict each other before and after. Article 14 stipulates: ”The implementation of contract management responsibility system, business operators must be on behalf of the contractor to sign a contract with the employer, the employer is the relevant department designated by the people’s government, the contractor for the implementation of contracting business."
