自1994年原建设部印发《全面深化建筑市场体制改革的意见》,推行管理层和劳务层两层分离以来,建筑业劳务用工制度“两层分离”的模式在建筑行业快速发展,一大批建筑劳务企业、劳务队伍成长起来,为建筑业提供了充足的劳动力资源,对建筑业健康增长发挥了积极作用。住建部先后于2001年、2007年、2015年三次修订《建筑业企业资质管理规定》,在劳务用工制度上延续了“两层分离”的模式。2016年4月11日,住建部批准了浙江、安徽、陕西3省开展建筑劳务用工制度试点工作方案,三个省份试点方案侧重点不尽相同:安徽省在全省范围取消了建筑劳
Since 1994, when the former Ministry of Construction issued the “Opinion on Deepening the Reform of the Construction Market System in an All-Round Way” and implemented the separation of the two management levels and the labor service level, the construction labor service system and the “two-level separation” model have been rapidly developed in the construction industry. A large number of construction labor service enterprises and labor service teams have grown up, providing sufficient labor resources for the construction industry and playing an active role in the healthy growth of the construction industry. The Ministry of Housing and Urban-Rural Development successively revised the “Regulations on the Qualifications of Construction Enterprises” in 2001, 2007 and 2015 and continued the “two-tier separation” model in labor and employment system. On April 11, 2016, the Ministry of Housing and Urban-Rural Development approved the pilot program for the construction labor employment system in Zhejiang, Anhui and Shaanxi provinces.
