随着经济技术的不断发展,技术标准与专利由分离走向结合,在巨大商业利益的驱使下,在技术标准的制定及实施环节出现了一些专利权滥用行为,对此应该通过专利法与反垄断法进行规制。文章总结了我国现行法律规制此问题的不足之处,在借鉴域外立法的基础上,为我国相关法律的完善提出几点建议。 With the continuous development of economy and technology, the separation of technical standards and patents has led to the emergence of some abuses of patent rights in the formulation and implementation of technical standards driven by the huge commercial interests. This should be done through patent law and anti-trust Law to regulate. The article summarizes the inadequacies of the current legal regulation in our country, and puts forward some suggestions for the perfection of the relevant laws in our country on the basis of drawing lessons from extraterritorial legislation.
