本文所称的“采光权”指不动产的所有权人或使用权人获取适当自然光照的权利。目前,我国相关法规对“采光权”受到侵害后的救济集中在侵权损害赔偿,这不免涉及到相关规划审批行为影响居民“采光权”的问题。但我国法律并未明确对该权利救济的方式。在审判实践中,各地法院对此类案件的判决局限为“确认行政行为违法”或“驳回起诉”。而受到侵害的实体权利并未得到有效救济。本文旨在通过对“采光权”的法律分析,探讨对居民“采光权”行政法上救济的方式和标准,以期对实践有所裨益。
The term “lighting right” as used herein refers to the right of the owner or the user of the real property to obtain proper natural light. At present, China’s relevant laws and regulations on the “daylighting ” after the infringement of the remedy focused on infringement damages, which can not help but related to the planning and approval of the residents “lighting right ” issue. However, our country’s law does not specify the way of remedying this right. In the trial practice, the judgments of such courts in various local courts are limited to “Confirming an Act of Administrative Act Illegal” or “Dismissing a Prosecution”. However, the infringed entity’s rights have not been effectively remedied. The purpose of this paper is to discuss the ways and standards of remedies for residents “lighting rights ” in administrative law through the legal analysis of “lighting right ”, with a view to the benefit of practice.
