《周易·讼卦》是当代法学界研究中国传统诉讼法理论、中国法律思想史、尤其是研究中国“无讼”法律思想所无法回避的话题之一。然而,当前人们对于“讼卦”的法律文化问题却缺乏专门的研究,本文从法律文化的境界角度,对“讼卦”进行了八大境界的分析探讨,并通过对其上乘境界——自然之境的论述,潜在地驳斥了“讼卦”的终极目标便是“无讼”的传统观点。 “Book of Changes, Lawsuit” is one of the topics unavoidable for contemporary jurisprudence to study the theory of Chinese traditional litigation law, the history of Chinese legal thought, especially the study of Chinese “no lawsuit” legal thought. However, the current people do not have a special study on the legal and cultural issues of the lawsuit. From the realm of legal culture, this article analyzes and discusses the Eight Realms of Lawsuits and analyzes the eight aspects of the litigation. - The exposition of the realm of nature, potentially refuting the ultimate goal of “litigation” is the traditional notion of “no suit.”
