因不同诉讼阶段对案件事实和证据的标准以及要求相异,这就决定了对刑事错案的认定无法制定统一的标准,但可以诉讼阶段为依据进行区分。逮捕作为一种刑事强制措施,其最首要也是最重要的职能,是对刑事诉讼活动顺利进行起到保障作用。因此,文章认为审查逮捕阶段的错案标准应着眼于逮捕的这一主要职能,首先需要对现行的逮捕三要件进行修改和完善,然后严格按照新三要件重新审视错案的认定标准。 Due to different litigation stages of the facts and evidence of the case standards and requirements are different, which determines the criminal misjudgments can not establish a uniform standard, but can be litigated stage basis for the distinction.
