市场经济的条件下竞争会带来优胜劣汰和社会生产力的发展,但对于航运业一定程度的集聚与垄断反而会更有利于航运业的稳定发展。因此世界上很多国家都确立了航运反垄断豁免制度,主要体现在对各种国际航运协议组织的反垄断豁免上,而班轮公会协议是其中最有代表性的。本文就以班轮公会协议反垄断豁免为视角,首先分析了航运反垄断制度的理论基础,然后探讨了欧盟与美国航运反垄断相关规定,最后再对我国未来航运反垄断立法作浅薄讨论。
Under the conditions of market economy, competition will bring about the survival of the fittest and the development of social productive forces. However, a certain degree of concentration and monopoly of the shipping industry will instead be more conducive to the steady development of the shipping industry. Therefore, many countries in the world have established the system of antitrust exemption for shipping, which is mainly reflected in the antitrust immunity of various international shipping agreement organizations, and the liner conference agreement is the most representative of them. From the perspective of antitrust exemption under the Liner Agreement, this article first analyzes the theoretical basis of anti-monopoly of shipping, then discusses the relevant provisions on anti-monopoly of the European Union and the United States shipping, and finally discusses the anti-monopoly legislation on future shipping in our country.
