当前保险消费者维权存在利益诉求超越合同范围、维权方式不正当等问题。本文分别对江苏地区产险、寿险公司进行了问卷调查,根据调查结果,分析了当前保险消费者维权中较为突出的四种不合理现象,以及维权方式向职业化和代理化发展的趋势。针对保险消费者权益的合理保护,本文提出应在反哺保险消费者的基本权益基础上,完善相关法制建设、完善社会和行业的保护机制,提高社会信用水平及市场透明度,探索保险纠纷的社会化管理模式,建立有效的市场秩序,保护保险消费者的合法权益。
At present, there are such problems as claims of interests beyond the scope of contracts and improper ways of safeguarding rights of insurance consumers. Based on the survey results, this paper analyzes four kinds of unreasonable phenomena that are more prominent in current insurance consumers’ rights protection and the tendency of the ways of safeguarding rights to occupation and agency. In view of the reasonable protection of insurance consumers ’rights and interests, this paper proposes that we should improve the relevant legal system, improve the social and trade protection mechanisms, improve the social credit level and market transparency, and explore the socialization of insurance disputes on the basis of reimbursement of consumers’ basic rights and interests Management mode, establish an effective market order and protect the legitimate rights and interests of consumers.
