随着经济的发展,城市的地下空间资源作为城市的自然资源,在经济、民生、环境以及城市的可持续发展等方面显现出越来越重要的作用。在19世纪末20世纪初,地下空间权作为一项崭新的权利类型,首先在美国、德国等发达的资本主义国家相继出现,且已为大多数国家的法律所认可。近年来,我国的城市建设呈飞速发展的态势,城市开发的不断深化同样带来了对土地的拓展利用,即对地下空间的开发和利用。本文探讨了地下空间权的取得问题.
With economic development, urban underground space resources, as the natural resources of the city, are playing more and more important roles in economy, people’s livelihood, environment and urban sustainable development. In the late 19th and early 20th centuries, as a brand new type of right, underground space rights first appeared in developed capitalist countries such as the United States and Germany and was recognized by the laws of most countries. In recent years, China’s urban construction has shown a trend of rapid development. The continuous deepening of urban development has also brought about the expansion and utilization of land, that is, the development and utilization of underground space. This article explores the issue of the acquisition of underground space rights.
