从法治文化的理论视角看,社会管理创新主要的体现为法律观念的创新和法律制度的创新。法律观念的创新,就是要建立一套适应于社会管理创新体制和机制的现代法律观念体系。法律制度的创新,就是要建立一套适应现代社会管理创新需要的法律体制和机制。观念创新是前提,制度创新是保障。观念创新为制度创新提供思想营养和理念基础,制度创新又进一步巩固、发展和塑造着人们的现代法律观念,并直接作用于社会生活。
From the perspective of the legal culture of theory, the main manifestation of social management innovation is the legal concept of innovation and legal system innovation. The innovation of legal concepts means to establish a set of modern legal concepts and systems that are adapted to the social management innovation system and mechanism. The innovation of the legal system means that we should establish a legal system and mechanism that meets the needs of innovation in modern social management. Concept innovation is the premise, system innovation is the guarantee. Concept innovation provides the foundation of ideological nutrition and ideology for institutional innovation. Institutional innovation further consolidates, develops and shapes people’s modern legal concepts and directly affects social life.
