目前,我国采用的仍然是封闭性的职业病目录的模式,即职业病目录中有规定的就是职业病,职业病目录中没有规定的即使是工作因素造成的疾病也不能被认定为职业病,有些因职业导致的疾病只有达到非常严重的程度才可以被认定为职业病。但是随着新技术、新物质材料、新化学原料的应用,新型职业性疾病不断出现,却得不到承认,加之我国缺少预防性的职业病名录,采用严格适用职业病名录的做法致使很多劳动者的合法权益得不到保护。我国的职业病名录已经严重落后于实际的需要,进一步调整和完善已成当务之急。
