如何在现行法律框架下先发制敌地进行反恐拘留是我国现行《反恐怖主义法》仍未解决的问题。法治发达国家通过降低对恐怖嫌犯的调查性拦截与调查性逮捕的标准并延长其拘留期限来修正根植于刑事法律框架内的调查性拘留体制,从而发展出了调查性反恐拘留这种修正体制,该体制具有较强的先发制敌的反恐功能。令人欣慰的是,该体制并不违反《公民权利与政治权利国际公约》关于任意拘留的禁止性规定。并且,它对我国具有重要启示:通过降低对恐怖活动人员的盘查、先行拘留和逮捕的启动标准,并延长对其先行拘留、侦查羁押和审查起诉期间的羁押期,打造适合我国的调查性反恐拘留体制。
How to carry out counter-terrorism detention under the existing legal framework is still an unsolved problem in our country’s current “Anti-Terrorism Law.” The developed countries with the rule of law have developed an amended system of investigative anti-terrorism detention by reducing the investigative interception and investigative arrest of terrorist suspects and extending the duration of their detention to amend the investigative detention system rooted in the criminal legal framework. The system has a strong anti-terrorism function of starting the enemy. Fortunately, the system does not violate the prohibition on arbitrary detention in the International Covenant on Civil and Political Rights. And it has important implications for our country: to reduce the number of terrorist activists who interrogate terrorists, prioritize detention and arrests, and extend their first detention, investigation and detention and review of detention during prosecution, and to create an investigative anti-terrorism suit for our country Detention system.
