蒋元文在《监督法没有规定个案监督并不等于不监督》(2007年5月22日中国选举与治理网)一文中指出,监督法对地方人大多年来在实践中积极探索的个案监督在立法中没有纳入调整和规范的范畴,不少地方认为个案监督行权无据,在实践中不便操作,从而使该项工作从今年开始处于停止状态,不少地方人大的案件监督处已撤销或处于无事可做的状态,对于反映到人大的个案则普遍按信访程序转相关部门办理,个案监督基本处于无人监督的境地。
