中小学教师在一所学校任教达到一定年限,必须按照规定参与教师的校际流动,中小学教师不履行交流义务将会受到责任追究。当前,关于教师交流的许多规范性文件欠缺法律规范结构中的制裁部分。中小学教师交流责任体系的创建应当以教师与教育行政部门及学校之间的主要法律关系为依据。该责任体系包括聘约责任和行政责任两大类。前者包括解聘、低聘、停聘和不续聘四种,后者涵盖行政处分、扣减工资、限制或撤销资格。教师交流的责任方式,既可以单独适用,也可以合并使用。
