解决农民工工资拖欠问题尚未形成统一成熟的操作方式。依据农民工工资支付担保是否强制,以及向谁提交的标准分为三种操作方式。通过比较,认为行政担保操作方式可以较好地弥补另外两种操作方式的不足。并从维护社会公共利益的角度分析了具有行政担保特点的农民工工资支付担保的正当性。 To solve the problem of wage arrears of migrant workers has yet to form a unified and mature mode of operation. According to migrant workers wages guarantee is mandatory, and to whom the standard is divided into three modes of operation. By comparison, it is considered that the mode of operation of administrative guarantee can make up for the deficiency of the other two modes of operation. And from the perspective of safeguarding public interests, this paper analyzes the justification of wage guarantee for migrant workers with the characteristics of administrative guarantee.
