“马锡五审判方式”是我国抗日战争时期在陕甘宁边区发展起来的一种大众化司法方式。这种审判方式把一切从实际出发、一切为了群众、一切依靠群众作为司法工作最根本的指导原则,其精髓在于体现了司法的人民性。本文通过分析“马锡五审判方式”与当前法院改革的相互关系,论证了“马锡五审判方式”所蕴含的价值理念与当前倡导的司法为民理念是一脉相通的,指出“马锡五审判方式”所蕴含的价值理念对于现代司法改革仍然具有重要的指导意义。 “Ma Xi five trial methods ” is a popular judicial way developed in the border region of Shanxi, Gansu and Ningxia during the period of our war of resistance against Japan. This mode of trial sets everything from reality to reality. Everything for the masses and all depends on the masses as the most fundamental guiding principle for judicial work. Its essence lies in reflecting the people’s character of the judiciary. By analyzing the interrelationship between the “Ma Xiwu Trial Methods” and the current court reform, this paper argues that the concepts of value contained in the “Ma Xi Wu Trial Style” are similar to those currently advocated by the judiciary for the people, It points out that the concept of value contained in “the method of judgment of Ma Xi” still has important guiding significance for the modern judicial reform.
