修正后的《消费者权益保护法》(以下简称《消法》)第24条扩大了“三包”制度的适用范围,赋予消费者更多的售后救济选择权。然而,《消法》存在对“三包”制度定性不一、执行机关违背民事纠纷救济机制等问题,导致“三包”制度在一定程度上反而限定了消费者的救济权利,与现行民事救济体系相冲突。本文将在准确定性“三包”法律性质的基础上,具体探讨有关制度的法律缺陷,并结合现行民事责任救济体系提出完善建议。
Article 24 of the amended Consumer Protection Law (hereinafter referred to as “Consumer Law”) expands the scope of application of the “Three Guarantees” system and gives consumers more after-sales relief options. However, there are some problems in the “Consumer Law”, such as the “Three Guarantees” system being qualitatively different from the “Three Guarantees” system and the executing agencies violating the civil relief remedy mechanism. As a result, the “Three Guarantees” system to a certain extent has instead limited consumers’ Conflicts with the current system of civil relief. Based on the accurate characterization of the legal nature of “Three Guarantees”, this paper discusses the legal defects of the system in detail and puts forward some suggestions based on the current civil liability relief system.
