社会关系的日益复杂导致刑事法律的复杂化 ,加之我国尚未形成专家型法官职业群体 ,因此 ,专家法律意见在我国刑事诉讼实践中具有存在的必然性。笔者参照两大法系国家对专家鉴定意见的规定 ,就我国专家法律意见的若干问题进行了研究。其内容主要包括 :专家法律意见的性质与特征、内容与形式以及质证与采证问题 ,并提出了专家法律意见质证的相关配套规则。
The increasingly complicated social relations have led to the complication of criminal law. In addition, our country has not yet formed a professional group of judges. Therefore, legal opinions of experts have their own inevitability in the criminal procedure practice of our country. The author refers to the provisions of expert opinion opinions of two major legal systems countries and makes some research on some problems of legal opinions of experts in our country. Its contents mainly include: the nature and characteristics, contents and forms of experts' legal opinions and the questions of the quality certification and the procurement of evidences, and puts forward the relevant supporting rules for the expert's legal opinions.
