检察官办案责任制改革是本轮检察制度改革的重心,旨在遵循检察权运行规律,突出检察官办案主体地位,建立一套能确保公正廉洁司法的检察权运行机制及依法独立公正行使检察权的管理体制。目前,各地检察改革试点工作有效推动了检察官办案责任制改革的顺利进行,但也出现了一些问题,需要各级检察机关和检察人员共同思考,深入研究。笔者重点对检察职能配置和运行的完善、检察机关内部权责关系的进一步厘清、检察人员分类管理的同步推进等方面进行了一些思考和探究,以期对检察官办案责任制改革实践与探索有所裨益。 Procurator responsibility system reform is the focus of the current round of reform of the procuratorial system, aimed at following the law of prosecutorial power, highlighting the prosecutor’s case as the dominant position, establishing a mechanism to ensure fair and honest prosecutorial powers and independent and impartial exercise of procuratorial power Management system. At present, the procuratorial reform pilot work in various places has effectively promoted the success of prosecutors’ reform of the responsibility system for handling cases. However, some problems have emerged that require the procuratorial organs and prosecutors at all levels to think together and study in depth. The author focuses on the prosecutorial function allocation and operation of the improvement of the prosecution within the power and responsibility to further clarify the classification of procuratorial personnel to promote the synchronization and so on some thinking and exploration in order to prosecutors handling the responsibility system reform practice and exploration of some benefit.
