证人出庭作证一直是诉讼活动的重要组成部分,是司法公证的保障。但现实社会中,证人不出庭作证的情况时有发生。笔者在客观分析了现象背后原因的基础上,提出完善我国证人出庭作证保障制度的若干构想,包括建立证人保护制度,建立证人经济补偿制度,建立强制证人出庭作证制度和证人拒证的惩罚制度,建立证人免证制度的方面,以期有效解决证人出庭作证的问题。

Based on the objective analysis of the reasons behind the phenomenon, the author puts forward several conceptions of improving the witness protection system in China, including establishing a witness protection system, establishing a witness economic compensation system, establishing a system of compelling witnesses to testify in court and a punishment system of witnesses’ The establishment of witness exemption system aspects, with a view to effectively solve the problem of witnesses to testify in court.
