1989年国务院发布的《人民调解委员会组织条例》第九条明确规定,经过人民调解委员会调解,当事人未达成协议或者达成协议后又反悔的,任何一方可以请求基层人民政府处理。这是我国行政法规第一次明确基层人民政府处理民间纠纷的职权,从而确定了它在治理民间纠纷中法定的地位。《条例》中这一规定,构成了群众性调解组织、基层政权机关、国家审判机关对民间纠纷齐抓共管的新格局。明确了基层人民政府的这一职权,强化了其行政管理措施和手段,有力地促进和保障了法律所赋予基层政权维护社会稳定,保障公民合法权益,促进经济建设的职责的实现。为更好地发挥基层人民政府处理民间纠纷
Article 9 of the “Regulations of the People’s Mediation Committee” promulgated by the State Council in 1989 clearly stipulates that after the mediation by the People’s Mediation Committee, if the parties have not reached an agreement or reached an agreement and then regret it, either party may request the people’s government at the grass-roots level to handle it.
