我国《保险法》第33、34条明确规定了未成年人死亡保险合同的问题。结合人身保险合同中保险利益的一般性规定以及未成年人死亡险的特殊性,法律通过规定父母投保、未成年人同意权、保险金额度等降低了该领域的道德风险,但在对比我国《民法通则》等法律以及世界上其他国家或地区的法律之后,不难发现我国未成年人死亡险规定中存在的漏洞。本文将从法律规范未成年人死亡保险合同的必要性出发,通过横向比较各国规定,分析我国现有规定的合理性及改革空间,望为相关问题探讨提供新思路。
China’s “Insurance Law” 33,34 clearly stipulates the issue of the death insurance contract for minors. Combined with the general provisions of insurance benefits in the life insurance contract and the particularity of the death insurance for minors, the law reduces the moral hazard in this field by stipulating parental insurance, juvenile consent and insurance premium, General Principles of Civil Law "and other laws in other parts of the world, it is not difficult to find the loopholes in the regulations on the death insurance for minors in our country. This article will start from the necessity of legal regulation of the death insurance contract for minors. By comparing the regulations of various countries across the country, this article analyzes the rationality of our existing regulations and the space for reform and hopes to provide new ideas for the discussion of related issues.
