2010年5月1日,《北京市公共场所禁止吸烟范围若干规定》正式在北京施行。2013年12月29日,中共中央办公厅、国务院办公厅印发《关于领导干部带头在公共场所禁烟有关事项的通知》,“禁烟令”正式开始规范民众生活。而早在九十年前,美国曾经以两条宪法修正案的方式设立又废止了具有相似意义的禁酒令。本文拟通过分析美国禁酒令实施失败的原因以及中国禁烟现状,探究美国禁酒令的失败对中国禁烟令实施的启示。
May 1, 2010, “Beijing Municipality, a number of provisions prohibiting smoking area” was officially implemented in Beijing. On December 29, 2013, the General Office of the CPC Central Committee and the General Office of the State Council issued the Notice on Leading Cadres Taking the Lead in Banning Smoking in Public Places, and the No Smoking Order officially started to regulate people’s livelihood. As early as ninety years ago, the United States once set up and repealed Prohibition orders with similar significance by way of two constitutional amendments. This article intends to explore the enlightenment of China’s ban on smoking by analyzing the reasons for the failure of the Prohibition of Alcohol Prohibition in the United States and the current status of smoking bans in China.
