常人方法学是美国20世纪60-70年代形成并发展起来的社会学理论流派。在以法律为主题的研究中,其通过对警察、律师、陪审员到法官以及其他法律实践活动的调查与观察,剖析法律活动的参与者如何处理日常法律实践活动,如何组织法和程序性的规则,如何构建持续稳定的法律秩序的观念,展示法律行动者处理日常法律事务的方法和技艺。与传统法律社会学研究不同的是,常人方法学认为法就是由具体的人在具体的时间里所做的具体的工作,通过观察社会成员的行动,让法律行动者自身来说出法律实践活动的组织性,法律判决以及其他法律行动这些现象,能够通过近距离的观察法律实践活动而清楚地表达出来,勾画日常法律情景中的真实面貌,在具体人的具体法律事务中建构法律秩序的真实感。
