工作环境权是我国劳动立法应当确立的劳动者劳动权利的重要内容,工作场所性骚扰行为侵犯了劳动者这一权利。从用人单位角度而言,则其有义务预防和治理工作场所的性骚扰行为,以维护良好的工作环境和工作秩序;否则也应当对行为对象承担一定的法律责任。这种责任应当在内涵与外延上同目前理论界较为主流的“雇主责任”相区别,并有着自己的责任形式和归责原则。
The right to work environment is an important part of labor rights that laborers should establish in China’s labor legislation. Sexual harassment in the workplace infringes the rights of laborers. From the employer’s point of view, it is obliged to prevent and control sexual harassment in the workplace in order to maintain a good working environment and work order; otherwise, it should bear certain legal liabilities to the bearers. This responsibility should be connotation and extension of the current theorists more mainstream “employer responsibility ”, and have their own responsibility forms and principles of attribution.
