城市规划变更是我国目前城市规划实践中面临的突出问题,通过对城市规划法法律体系的梳理,可发现城市控制性详细规划变更的法定要件存在诸多问题。应在此基础上,提出应当规范评估引起规划变更的要件,提出并明确公共利益要件,以期提高我国城市规划变更的科学性和稳定性。
The change of urban planning is a prominent issue in the current practice of urban planning in our country. Through the review of the legal system of urban planning law, we can find that there are many problems in the legal requirements for the change of detailed planning of urban control. On this basis, it is proposed that the elements that cause planning changes should be standardized and evaluated, the elements of public interests should be proposed and clarified, with a view to improving the scientific and stability of the urban planning changes in China.
