不动产登记瑕疵是指不动产登记簿记载的物权与实际权利不相符合的事实状态,主要包括错误登记和漏记两种情况~②。在我国,物权的变动采公示公信原则,登记即具有公信力,即使登记存在瑕疵,法律保护善意第三人。然而,实践中瑕疵登记的现象时有发生。在不动产登记有瑕疵时,真实权利人的权利应当如何保护?保护善意第三人和保护真实权利人之间应当如何平衡?我国的《物权法》对此作何规定?此种规定是否能较好解决瑕疵登记问题?本文拟对这些问题进行探讨。
Real estate registration flaw refers to the actual records of real estate property rights and actual rights do not match the fact that the state, including error registration and missed two cases ~ 2. In our country, the change of real property adopts the principle of public trust, and the registration is credible. Even if the registration is flawed, the law protects the goodwill third person. However, the practice of flaw registration phenomenon has occurred. How to protect the rights of the true proprietor when the property is registered with flaws? How to protect the bona fide third party and protect the true rights holders? What is the “Property Law” in our country? Solve the problem of defective registration? This article intends to explore these issues.
