本文通过对国际拍卖行拍卖规则的分析,探究了拍卖行形成拍品权利瑕疵免责行规的深层根源以及该免责给即将于明年春季在巴黎拍卖的鼠首和兔首铜像回归所带来的障碍。并针对现实情况,提出了我国对于流失海外文物在拍卖成交之前和之后分别通过所有权举证和侵权之诉进行追索的新道路。
By analyzing the auction rules of the international auction houses, this article explores the deep root cause of the exemption rules of the auction house from the defects of the auctioneers’ rights and the obstacles brought by the exemption to the coming back of the rat and the first bronze statue of the auctioneers in Paris next spring. In the light of the actual situation, a new road was proposed in our country for the loss of overseas cultural relics through the prosecution of evidence of ownership and infringement before and after the auction.
