本文以安徽省蚌埠市百对夫妻集体离婚报道为切入点,重点关注农村房屋拆迁补偿中出现的以假离婚或假结婚方式骗取安置住房的现象,指出该行为的违法性。为从根本上杜绝该现象的发生,笔者认为有必要参照城市房屋拆迁补偿方式,建立以市场价值为基础,城乡统一的房屋拆迁补偿制度,彻底改变以单独户或每户家庭人口数作为补偿标准的做法,通过完善集体建设用地基准地价评估与农村房屋估价规范等配套制度,充分实现农村房屋拆迁补偿制度的公平与科学。
This article takes a collective divorce report of a hundred couples in Bengbu, Anhui Province as an entry point, focusing on the phenomenon of fraudulently settling houses by fake divorce or fake marriage in compensation for demolition of rural houses, pointing out the illegality of the act. In order to fundamentally eliminate the occurrence of this phenomenon, I think it is necessary to refer to the compensation method of urban housing demolition, the establishment of a market value-based, unified urban and rural housing demolition compensation system, a complete change in single household or household population as a compensation standard By improving the standard system of collective land for construction land evaluation and rural housing valuation norms and other ancillary systems to fully realize the rural housing demolition compensation system of fairness and science.
