彩票作为国家公开发行、募集社会公益性用金的手段,为我国基础设施建设作出重大贡献。但我国现有彩票管理制度还存在很大缺陷,突出表现在个别彩票发行机构、销售机构利用相关行政法规的漏洞对彩票中奖者信息不透明,甚至有哗众取宠,监守自盗的违法行为。本文通过分析彩票所具有的公益性、彩票中奖者的公众性来论证对彩票中奖者精神人格进行限制的必要性,从而打消公众疑虑,保障公民知情权,规范彩票市场。
Lottery as a national public offering to raise funds for social welfare means to make a significant contribution to China’s infrastructure construction. However, the existing lottery management system in our country still has a lot of shortcomings. It highlights the fact that the individual lottery issuers and sales agencies use the loopholes in the relevant administrative regulations to make the information of the lottery winners opaque and even illegitimately violate the law. This article analyzes the necessity of lottery winners’ public welfare and the lottery winners’ publicity to restrict the spiritual personality of lottery winners, so as to dispel public doubts, protect the citizens’ right to know, and regulate the lottery market.
